At a time when some of the founding values of our civilization are being called into question, and fighting seems to be the only solution to resolve differences and conflicts, collaborative negotiation can play a central role in pursuing the goals of solidarity and sustainability set forth by the UN 2030 Agenda and enshrined in our Constitutions and Community Charters.

Nonetheless, in Italy, interest in the dynamics that trigger conflict and in the techniques for resolving it is relatively recent.

Professionals who have made the necessary paradigm shift and embraced the logic of collaborative negotiation are still relatively few; too few to meet a challenge that now involves the generality of businesses, both private and public.

This is the reason why we wanted to be one of the first law firms to create a multidisciplinary collaborative negotiation team, with lawyers specially trained and experienced in non-adversarial negotiation techniques.

From year to year is getting larger the number of sectors in which collaborative negotiation is the most effective tool for preventing and resolving conflicts, building stable and lasting relationships, and identifying shared solutions by reaching broad consensus:

  • from M&A operations, joint ventures, private/public partnerships, construction contracts, in which conflict prevention and management is crucial, to preventive restructuring frameworks aimed at reaching out-of-court settlement with creditors;
  • from ADR procedures to family disputes and inheritance and property controversies;
  • from company conflicts to negotiations with workers and trade unions.
