Bankruptcy law and corporate
restructuring.
Franco Baudino e Associati advises clients in insolvency
procedures, helping troubled companies both in and out-of-court and
advising interested parties in buying businesses or assets from failing
companies or those subject to bankruptcy or receivership procedures.
In this area, our firm advises companies in negotiating debt restructuring
and debt consolidation agreements necessary to help overcome the
business difficulties. Working in an integrated way with our network
of accountants, tax and employment law consultants, we are able to
pursue all of the procedures including employment law (principally
regarding the claims to state redundancy funds and procedures).
We have devoted special attention to studying the bankruptcy law
reforms, and we have followed and concluded some cases by following
the new receivership procedures and also using new protection instruments
such as trusts, in order to achieve arrangements with creditors for
groups of companies.
From another standpoint, we advise creditors and investors, both
institutional and private, in their dealings and negotiations with
companies in difficulties, in liquidation, or in bankruptcy. We advise
the official receivers or trustees of bankruptcy cases relating to
multinational companies with cross borders bankruptcy procedures
impacting on more than one jurisdiction. |
